Terms of Service — Portly.me

1. Agreement to Terms

These Terms form a binding agreement between you and Portly.me. If you do not agree, do not use the service. If you are using the service on behalf of an organization, you represent that you have authority to bind that organization.

2. Eligibility & Accounts

You must be at least 13 years old (or the age required by law in your region).
You are responsible for maintaining the confidentiality of your login credentials and for activity under your account.
Provide accurate information and keep it up to date (e.g., email, billing details).

3. Your Content & Licenses

You retain ownership of content you add to your profile and links (“User Content”). You grant Portly.me a non-exclusive, worldwide, royalty-free license to host, display, and distribute User Content as necessary to operate the service.

You are solely responsible for User Content and for ensuring you have all rights to post it. We may remove content that violates these Terms or applicable law.

4. Acceptable Use

You agree not to use the service to:

Violate any law, regulation, or third-party rights.
Post or link to illegal content, malware, adult sexual content, or material that is defamatory, hateful, or otherwise harmful.
Interfere with or disrupt the service, including by overloading, scraping without permission, or attempting to bypass security measures.
Impersonate others or misrepresent your affiliation.

5. Subscriptions & Billing

Paid plans are billed via Stripe. Pricing, features, and plan limits are described on our pricing page. Taxes may apply. By starting a subscription, you authorize us and our payment processor to charge the applicable fees to your selected payment method on a recurring basis until you cancel. Proration may apply on upgrades/downgrades.

6. Cancellations & Refunds

You can cancel at any time from your billing settings or via the Stripe Billing Portal. If you cancel, you will retain access to paid features until the end of the current billing period unless you select “cancel immediately.” Fees already paid are generally non-refundable except where required by law.

7. Privacy

Our processing of personal data is described in our Privacy Policy. By using the service, you acknowledge that processing.

8. Analytics & Link Tracking

We collect metrics about link clicks and profile activity (e.g., timestamps, referrer, country derived from IP, device information) to provide analytics and maintain security. See the Privacy Policy for details.

9. Third-Party Services

The service integrates with third parties (e.g., Vercel, Supabase, Stripe). Your use of any third-party services is subject to their own terms and policies. We are not responsible for third-party services.

10. Intellectual Property

The service, including software, design, and branding, is protected by intellectual property laws. Except for the limited rights expressly granted to you, we reserve all rights.

11. Beta & Experimental Features

From time to time we may offer beta or experimental features. These are provided “as is,” may change or be discontinued, and may have different availability or support levels.

12. Suspension & Termination

We may suspend or terminate access if you violate these Terms, create risk or legal exposure for us, or for prolonged inactivity. You may terminate at any time by canceling your subscription and deleting your account.

13. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PORTLY.ME AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

15. Indemnification

You will indemnify and hold Portly.me and its affiliates harmless from any claims, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the service, your User Content, or your violation of these Terms or applicable law.

16. Governing Law & Venue

These Terms are governed by the laws of Slovenia, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in Ljubljana, Slovenia, for any dispute arising out of or relating to these Terms or the service.

17. Changes to the Service & Terms

We may modify the service and these Terms from time to time. We will post updated Terms with the “Last updated” date above. Material changes may be communicated via email or in-app notice. Your continued use after changes become effective constitutes acceptance of the updated Terms.
